Terms & Conditions

Information about purchasing original artworks, commissioned paintings and using this website.

Last updated: 22 October 2026

1. Seller and application of these terms

This website, sekar.de, presents original artwork by Sekar Rajagopal, an artist based in Frankfurt am Main, Germany. These terms explain the general conditions for enquiries, purchases and commissioned artworks arranged directly through this website or by email. The seller's full legally required identification and postal contact details are provided in the Imprint. Individual written agreements may specify additional details for a particular work.

2. Originality and artwork information

Unless expressly identified otherwise, paintings offered for sale are individual, original artworks, not limited-edition reproductions. Artwork pages describe the medium, approximate dimensions, date, framing and presentation. Measurements are given in the order stated on the relevant artwork page. Photographs are intended to show the work faithfully, but screen settings and lighting may cause some differences in appearance. Small characteristics of hand-painted surfaces are integral to an original artwork and are not necessarily defects.

Availability can change without notice. An enquiry, request for a quotation or offer does not reserve a painting or itself establish a purchase contract.

3. Enquiries, offers and contract formation

Visitors may contact the artist to enquire about an artwork, request a commission or propose a purchase price using the contact form. Any price, availability, payment method, shipping destination and special requirements will be confirmed directly. A contract is formed only when the parties reach a clear agreement about the artwork and essential purchase conditions; simply sending an offer does not constitute acceptance by the artist.

4. Pricing and payment

Prices are confirmed individually and will indicate the applicable currency and tax treatment before a purchase is completed. The accepted payment method, amount due and payment deadline will be stated in the written purchase confirmation or invoice. Buyers should not send payment until they have received verified payment instructions. The artwork remains the property of the seller until the agreed purchase price has been paid in full, to the extent permitted by applicable law.

5. Shipping, packing and delivery

For artwork listings that state “shipping included,” standard secure packaging and the agreed standard shipment to the confirmed destination are included in the quoted purchase price. Original paintings are packed with care in a protective shipping box. The shipment method, expected dispatch window and delivery destination will be confirmed before purchase. Unusual delivery requirements or destinations may require a separate quotation, which will be disclosed before the agreement is finalized.

International collectors may be responsible for import duties, customs charges or destination-country taxes where legally applicable, unless the written purchase agreement expressly provides otherwise. Delivery estimates are estimates, not guaranteed arrival dates, and mandatory consumer rights in cases of delay or non-delivery remain unaffected. Risk of accidental loss or damage passes in accordance with applicable law; these terms do not shift that risk to consumers prematurely.

6. Receipt and transport damage

Please inspect the parcel and artwork reasonably promptly after delivery. If the packaging or painting appears damaged, retain the packaging, take photographs and contact mail@sekar.de so the issue can be investigated. Reporting damage promptly helps resolve insurance and shipping claims, but it does not remove any statutory rights or impose a shorter legal notice period on consumers.

7. Cancellation, withdrawal and 14-day satisfaction

Consumers who purchase an eligible artwork through a distance contract may have a statutory right to withdraw within 14 days of receiving it without giving a reason. To exercise that right, send a clear statement of withdrawal to mail@sekar.de before the applicable deadline. A separate, legally compliant withdrawal notice and model withdrawal form should be supplied to eligible consumers before their contract is concluded.

Artwork listings may also refer to a “14-day satisfaction guarantee.” That promise is intended to support collectors and does not replace, reduce or override statutory consumer withdrawal or warranty rights. Any voluntary return conditions that go beyond statutory rights, including who pays for return shipping, must be agreed and communicated clearly before purchase. In the absence of a more generous agreed policy, statutory rules apply.

Where the law provides a withdrawal right, the buyer must return the artwork within the applicable statutory period after notifying the seller. Refunds, allowable deductions and return costs will be handled under mandatory law and the legally required pre-contract information. Please contact the artist for suitable return-packing instructions to protect the work in transit.

8. Commissioned paintings

Commission requests are welcome and are discussed individually. A commission agreement should set out the proposed subject, dimensions, medium, total price, payment stages, approximate completion period and any agreed opportunity to review the work. Because commissioned paintings can be made to a buyer's individual specifications or clearly personalized, the statutory right of withdrawal may not apply where the legal requirements for that exception are met. This exception is not automatic for every commissioned work and does not affect rights relating to defective or nonconforming goods.

9. Authenticity and ownership

Each original artwork is supplied with a Certificate of Authenticity as stated in its listing. Signature placement, if relevant, is given on the artwork detail page. Physical ownership of a painting transfers in accordance with the completed purchase agreement; copyright and other intellectual-property rights are not transferred merely because a painting is purchased.

10. Copyright and image use

Unless expressly agreed otherwise in writing, Sekar Rajagopal retains copyright in original artworks and the artist-created images and text published on this website. Purchasing a painting does not grant permission to commercially reproduce it, create merchandise from it, or license its image to third parties. Requests for publication, reproduction or commercial use should be made in writing.

11. Permitted use of the website

You may browse the website, share links to its pages and contact the artist for lawful purposes. Please do not interfere with the security or availability of the website, attempt unauthorized access, impersonate another person or submit fraudulent or unsolicited commercial messages through the contact form.

12. External websites and privacy

Links to external sites are offered for convenience. Their operators are responsible for their own content and practices. Personal information submitted in an enquiry is used to respond and, where applicable, arrange a purchase; a separate privacy notice should explain data processing and the rights available under applicable data-protection law.

13. Legal rights and liability

Nothing in these terms excludes or restricts liability or remedies where doing so would be unlawful, including mandatory consumer protection rights and statutory rights in relation to defective goods. The artist is not responsible for interruptions or delays beyond reasonable control to the extent allowed by law, without prejudice to mandatory rights.

14. Applicable law and resolution of concerns

German law generally governs agreements with the seller, without depriving consumers habitually resident elsewhere of protections that cannot be excluded under applicable conflict-of-law rules. Any mandatory rules concerning jurisdiction remain unaffected. If you have a concern about a purchase, please contact the artist first so that a practical resolution can be explored.

15. Updates and contact

These terms may be revised to reflect changes to the website or business. The version agreed at the time of a purchase governs that purchase unless the parties lawfully agree otherwise. For questions about artwork, orders, delivery or these terms, write to mail@sekar.de or use the contact page.
